AFC Wimbledon (again) Petition

You all know what this is about....

 

Now I'm not about to go on about "it's wrong they got thrown out of the Trophy" or "they should never have been deducted the points in the league" but at the end of the day is it really fair that all this is over is the lack of international clearance of an English man playing in an English league.

 

There are cases where, if the rules are broken then the teams should be punished but I believe each case should be classed on their own merits. What basically happened is the guy retired from the game after getting injured playing for Cardiff who obviously play in the English League. Once he is retired that should be it, if he comes out of retirement then he should have got new registration details.

 

Looking at the West Ham case it looks like a lot more cut and dried. At the beginning of the season the shareholders, the 20 member clubs, meet and decided on the laws. If one of the laws is broken then the Premier League along with the Shareholders decide what should happen. In this case West Ham has been charged by the Premier League and the case will now go to a separate commission where they will decide on the punishment. So the Premier League won’t decide as they brought the case, the commission will so it's effectively West Ham United versus the Premier League.

 

In AFC Wimbledon’s case however it is slightly different. The Ryman League and their shareholders don't take a vote on the rules of that competition; they are decided and laid down by the FA, no votes and no shareholders a group of men in a small room deep in an underground bunker in the early hours of the morning. You may remember some time ago AFC Dons tried to appeal to the Court of Arbitration to Sport but were told they were not allowed as the court did not have jurisdiction yet they do have jurisdiction with UEFA and FIFA.

 

This then goes a lot deeper then just the AFC Dons case. Why, when the FA decides something can it not be challenged by an independent commission like the Premier League allows? Not any old commission but one that holds rank with UEFA and FIFA. The whole thing for me proves that the FA is out of date and has completely lost touch with their "members".

I agree that the punishment is harsh , but to look at each case on its merits is very dodgy leagl area. It if for this reason that in a court of law , the magistrate/judge does not decide the charge , but the CPS. A jury (or magistrates) decide on a guilty or not guilty verdict. The magistrate/judge undertaking the sentcance has directives from the Home Office on relevant sentances for each guilty verdict.

 

The FA lay down the rules and thats that. I agree however that there should be a challange against the structure of the FA.

 

Speaking to jimmy at Woking , it does seem that the form they filled in which also gives guidelines is very simple and fool proof.

 

The other issue with whay you stated, is that if aplayer retires and unretires he should be registered is unworkable , in that , unless there is a significant time (5 years maybe) between the two events , do you not see players retiring fo rthat very reason.

 

Will be a good debate for minibus one day
