its more simple than that TBG but also complicated in so much as the original social club still exists and it was that entity that actually paid for and rebuilt the clubhouse in 1986 after the fire and it is also the social club that has always paid for the refurbishments and fixtures in the clubhouse....the social club was not caught up in the 2004 debacle and therefore retains quite legally its title to goods purchased and paid for..there are laws against outside bodies interfering with the day to day business of a profit making organisation...

HFCL spent a lot of money refurbishing the stadium and purhasing fixtures inside the arena such as seating blocks and burger bars and toilet blocks etc etc etc...after the liquidation of that company in march 2005 the new company HFC(2005)L purchased the assets and goodwill of the previous company from the liquidators (and for the avoidance of any doubt here... those assets were advertised and the succesful offer from HFC(2005)L was the highest of several) all of those assest are the subject of an invoice from the liquidators to HFC(2005)L and that invoice has been paid in full. Title is absolute over the fixtures and fittings at the stadium.

Property placed on feehold land by a tennant belongs to the tennant not the freeholder. The law of property act protects tennants over these issues and the transfer of undertakings as the football club continued to occupy the stadium and maintain it through the change of limited company is absolute in the current clubs right to occupy the stadium. The council are at liberty to give you their consent to play football at the stadium but they are not at liberty to give you their consent to use any asset belonging to HFC(2005)L or indeed the HFC Social Club.

All of that aside the issues raised recently and made public today run far deeper than just will it or won't it happen....it can never happen because it is just NOT possible to make it work...if everyone forgets tribal differences here and steps back objectively.. even the dumbest pea brain will work out that such an arrangement will see the end of senior football for both clubs in the medium term...(and their succesful youth development policies)

another good thought process here for amusement purposes only of course is a somewhat parralex view of the whole issue..

is this really about the two football clubs or is it about other issues self serving to the council....?

I have no idea Unc but what AFCH claim the right to own at Bridge Avenue certains raises some interesting points.

Presumably the original HFC obtained their landlords permission to make the additions to the faciltiies that they undertook at the stadium and got the appropriate planning right to do so too.

all current planning, fire, licencing and building regulation certificates are up to date and were issued through the appropriate departments at the town hall.

Don't worry Uncs. We've got our own collapsible football stadium kit which we can take with us anywhere. It includes ready made turnstyles! grin

the council cannot win this one and in that respect nor can romford....

 

at the moment its win lose lose with us first...

 

that needs to change for owt to happen and as I am now retired and restricted from involving myself in such matters....then someone needs to get their brain working...mind you I have it on good authority that once high court action is activated there will be no going back...big bucks are being spoken of here in temple chambers and geves and hawks clad... bewigged legal eagles are slowly sipping their friday afternoon claret whilst adding up their percentages of the compo....

The Recorder used quotes from Jon Smith in their article, Im begining to suspect with so many matches postponed last week they had a lot of space to fill.

fact of the matter is that should romford move to the bridge there would be only one winner,that would be romford.

There would be two losers.Afc Hornchurch & the athletics club.

Afc Hornchurch would lose out not being able to play any games other than first team games at the bridge.This means our youth teams,capital league would miss out on playing on a decent pitch week in week out.

The stadium would be overstretched and anyway romford is a big enough town to be able to host essex senior league football instead of having to harm any chances AFC Hornchurch would have of progressing as a club.Thats how much our friend zody and his cronies actually care about local Football.

 

Romfords 5 miles away so go play there!!!
