This will upset Gavin..

Well that is so sad, I am personnaly upset at that my-self, I used to live down in Edgware for 8 years during the 1980s and when my wife and I went there on Saturday we hardly recognised the place, this is very sad but that is progress I presume.

Gavin did everything he could to save the W.L.G. and I have to say I feel sorry for him right now.

Third parties, i.e. those affected by a planning permission decision but neither the council or the applicant, do not have a right of appeal against the granting or refusal of planning permission.

You can only appeal to the courts if you feel the Council has acted outside it's powers. If such an appeal is succesful all that would happen is that the Council would be compelled to make a new decision. They could make the same decision again and it would stand as long as they showed that they acted within their powers.

 

If I were you I would check the conditions on the planning permission and ensure that the developers stick to them. It sounds like one condition will be to provide you with a new ground and I would seek to ensure they do that first before they develop the WLG.

The club are to seek a Judicial review of the application as it was fundamentally flawed.

No development is allowed on the ground for three years and if at the end of that period the PEPF is not completed or ready to allow Edgware to play their the planning permisson expires.

Good luck with the judicial review. They can be very difficult to stick and like I say they don't necessarily alter the ultimate decision.

Best outcome would be the next decision being called in by the Secretary of State and getting one of thier inspectors to make the recommendation.

 

The conditions that have been attached actually also seem quite stringent and I wouldn't be surprised if the developers, from what I have read about them, appeal to get some of the conditions dropped.
