I suggest we all write to Stockport and ask for the video footage of us in the crowd, we were all told that we were spotted on CCTV so by law we are able to ask for that footage.

 

If you want a copy of a letter (word doc) that you just need to tinkle with then click here this is taken from the Mark Thomas website and your allowed to use it.

 

If you want to know how the data protection act works then read below (also taken from the Mark Thomas website) it'll cost £10 but i think it's well worth it:

 

[color:"red"] We are all aware of some of the companies that hold information about us - our banks, doctors and even supermarkets and chain stores with their customer loyalty cards. Much of this information is held to our advantage, however, when this information is cross referenced, sold on or becomes outdated or inaccurate, individuals end up with junk mail, incorrect decisions being made about them or worse. The Data Protection Act governs the way that information is handled, as well as giving you access to that information and the right to have any errors corrected.

 

The Data Protection Commission was set up to administer the Act and they are very helpful if you have any questions. Their website also contains a large amount of information that may be useful - www.dataprotection.gov.uk

 

The rights you have under the Act are:

 

The right to access data held about you.

The right to prevent processing where it is causing you substantial distress under some cases

The absolute right to prevent processing for direct marketing.

The right to prevent automatic decisions being undertaken based solely on the data held about you, under certain cases.

The right to claim compensation from a Data Controller for damage and distress under certain cases.

The right to rectification, erasure and destruction of incorrect data or expression of opinions.

The right to ask the Commissioner whether the Act has been contravened

 

How To Use Them:

 

If an organisation holds information on computer or certain paper files about you personally, you have the right of access to that information. This is called the 'Right of Subject Access'. If that information is not correct, you also have the right of alteration or deletion of that information.

 

To get access to your information, you need to write to the organisation that is holding the information. Each organisation has to appoint a person or department who acts as a Data Protection Officer and will be your point of contact. If you do not know their name, just use Data Protection Officer. You need to supply details of your relationship to that organisation and where they might find information held on you. For instance, if you are an employee give your payroll number etc; if you are a customer then give information as to your point of purchase of goods or services. The more information that you can give them about where they may find the information the more likely it is that your request will be wholly sucessful.

 

You may need to supply £10. The organisation is entitled to make a maxium charge of £10 to cover costs of searching for your data. This should be a cheque or postal order and is payable only once.

 

When you have done this you are entitled to a reply within 40 days from the Data Protection Officer. However this reply may not be the data you are requesting, merely a letter to say they are looking into it and need more time, or that they will not be releasing the data. Apart from a few exceptions, you should get back all the information held in the organisations various files and systems that mention or refer to you personally or an opinion about you. This can include personnel department files; emails from, to and mentioning you; letters on file; reports mentioning you etc. You may not receive the full email/report; however, you should receive enough for you to be able to understand the context in which you are mentioned. References to third parties should have been removed or obscured.

Sorry to hear about the trouble you has with our stewards on sat. What were you upto? It didn't seem like much from up in the Cheadle end. But then they started sendin in cops and stewards. I rhink you were hard done by and should write to the club and police about it.

Not too sure what you hope to achieve doing this. At best you might receive a video and a grovelling apology, more likely a total blank. I would write to their club and any local papers you can find, one of them may print it you never know, the NLP was a good idea too, not to mention the FA.

 

One last thing, before sending any letters, run them through a Spelling and Grammar checker, it does make a difference believe me.

Ok, I know I have nothing to do with this, but I do think EFM,The Firm,The Voice is right to suggest what he has. At least you're taking a stand,if you feel you've been hard done by then it's important to stick up for yourself. Even if you get nothing out of it,at least you've made a point and got you're voice heard.If enough people write letters then they'll get the idea pretty sharpish!

By law they have to comply. It's not a case of they might just ignore it. If they don't comply they can be reported. They have 40 days to respond.

 

CCTV is a dodgy issue these people can just record and monitor who they like with no proper regulation, I was told I was seen on CCTV being foul and abusive (good lip readers then) therefore I want a copy of the tape, if this is not the case therefore I consider that slander and will take action.

 

They also have to distort all the images of the people around me so that'll mean sending it off to be done proffesionally.

 

Chubbhead you're right you have to stand up to these ba*tards, the police/stewards always find some law to get what they want, they wanted us out with no right of complaint or discussion, well this is also law so bring it on.

 

Rob, I'm afraid writing to papers and so forth isn't that great, they'll edit what you write and be selective about what they print, I'm not saying don't do it but why shouldn't we use something that is designed to protect us to our advantage. Dear Sir or Madam

 

My name is ***I don't want you lot knowing my middle name****, I am a 28y r old male and was travelling with the away supporters of St.Albans City FC on Saturday 16th November 2002.

 

I am writing to request a video recording of myself to which I am entitled to under section 7(1) of the Data Protection Act 1998 is sent to myself at the above address.

 

I was present in the away stand between the back row and a couple down at various points on 16th November between the hours of 1445 and 1540 during the FA Cup 1st Round game between Stockport County and St.Albans City

 

I was aware that I was being filmed by one of your cameras in this stand as advised by a member of your stewarding staff.

 

You can identify myself by the following description: I am approx. 6ft tall with a shaven head, I have a nosering (left nostril) and wear glasses. On the day in question I was wearing a blue St.Albans City football shirt and a orange jacket, I did have the orange jacket around my waist at some points, I was also wearing very light blue trousers. If you are looking to identify me I spent a period sitting in the back row by the tunnel to your food area, I spent some time at the food area, I joined the stadium by walking at the bottom of the stand before making my way up the stairs (the staircase to the tunnel as previously mentioned). I also spent some time with a large group in discussion with your stewards. I can also be identified walking behind the Railway Stand.

 

I would hope that you would be able to comprehensively search all your recordings. However, to assist you with my request I would suggest that you first focus on the bottom of the stand approx. 1445. The food area at approx. 1500 and 1505 and in the stand from 1505 to 1540. The railway end with your stewards at approx. 1540. I was not present on your property before 1445 or after 1545.

 

As you may be aware, the definition of “personal data” under the new Act covers information that is recorded on video and film and if these are recorded on tape by yourselves, I am also entitled to this data. I am also entitled to any data you hold about me which is written.

 

I would also draw your attention to the CCTV Code of Practice for Data Protection Act (specifically ‘Access by Data Subjects’, points 8 through to 11) which suggests that other individuals who are also caught on film around me should be ‘disguised or blurred’ in line with the Sixth Data Protection Principle, and sets out principles for how this work should be undertaken.

 

I ENCLOSE A PHOTOCOPY OF MY PASSPORT (OR OTHER IDENTIFICATION) AND A RECENT PHOTOGRAPH OF MYSELF TO AID YOUR IDENTIFICATION AND RECOGNITION OF ME.

 

I AM ALSO ENCLOSING A CHEQUE FOR £10 PAYABLE TO YOURSELVES, WHICH IS THE PRESCRIBED MAXIMUM UNDER THE ACT. *See note below

 

If you do not normally handle these requests for your organisation, please pass this letter to your Data Protection Officer or another appropriate official.

 

I understand that under the Act I should be entitled to a response within 40 days and I look forward to hearing from you at your earliest convenience.
