I don't think its a set time thing dave but more 'reasonable care'....

 

the problems are of course twofold...the writer I believe is guity of slander if the posts is indeed scurrilous and falsly malicious...the printer or publisher of the slander is then guilty of libel and thats where the owners of the forums come into play...the mods are outside of the chain of responsibility other than by not removing such posts and thereby putting the forum owners (the publishers per se) at risk...

 

a case for slander bears no time..if its only on for 4 seconds it still counts....libel against the publisher is a matter of reasonable care and I guess that is always open to interpretation....I read that 24 hours in one case was deemed to be 'not reasonable care' but in another over a sunday period it was...

 

most public forums are lodged in offshore companies to protect the ultimate owners from libel action...you can't sue who you can't identify...

 

have to say tho that I have seen nothing untoward on the romford forum before it was removed....

I wonder if Enfield Town's Forum regulars felt the same way? What would you be posting rightnnow if Romford FC had just been forced to fold following legal action because of something posted by one of its Supporters on a Forum that it had responsibility for moderating? You'd probably be saying that the Club should have seen it coming and done something to protect itself.

Well, that's exactly what has happened. I know that closing the Forum is an extreme measure but it has to be better than running that risk - and, believe me, the conditions were very much in place to put the Club and it's Officers at risk - and not for the first time! I, for one, don't want to be in that situation.

If, for example, an Arsenal supporter posts something on the BBC's "606" forum that says something defamatory about, say, an official of Manchester United, there is no doubt that Arsenal would not be responsible in any way but the moderator and operators of the BBC forum, plus the person making the post, might well be. If, however, the same comment is posted on Arsenal's own forum, then the Club WOULD have a responsibility for allowing the post to appear and could be open to action against them if the subject of the allegation could prove that the comment was incorrect and/or malicious.

I'm sorry if you still don't understand why the decision was taken - but I, for one, fully support those that took that decision. I'd rather the Club was a "laughing stock" for closing it's Forum than for leaving itself vulnerable to libel action!

Like I said, if someone would like to start a Romford Supporters' Forum, there is nothing to stop them......and the Club wouldn't be able to "censor" it! How about it??

Stanley Standard 2, me old china,yes it was tongue in cheek <img src="/forum/images/graemlins/grin.gif" alt="" />, it has happen before aswell, floodlight failure, the 2 happy groundsmen that Fords provide turn the light off 10 minutes after our game yesterday,jobs worth
