Maybe if you are to be released during the time of the next government then yes otherwise no.

For example Jake will be out a month after the election and wouldn't of had a say even though he'd be a free man for up to 4yrs 11 months of the next government and it would affect him. It's pointless somebody like Ian Huntly having the vote unless it was the casting one for the party that was going to bring back hanging and back date it.

It would be impossible to make it work like that though. You have no guarantee there will be five years between elections, and no cast in stone release dates for prisoners.

 

I reckon they waive their right to vote when they commit a crime and subsequently get sent down. However, there are people inside who shouldn't be, and people who are given non custodial sentences that should be sent down, but that is a different matter.
