Further Update

The Club reported on its website yesterday that it was expecting to receive a letter of offer from Thanet District Council confirming the status of the Proposal/Licence for the new stadium site at Hartsdown Park.

The Council had indicated in telephone conversation Wednesday afternoon, that upon advice from their own legal department, the proposal by the Council to enter a licence with the Club was not a suitable vehicle and it was based upon that conversation that the Club was hopeful the letter of offer would include the offer of a lease and not a licence. We are able to confirm that the Club has received the Councils offer, which requires a formal response from the Club within 5 days.

Under the terms of offer from the Council they require the completed stadium to be handed back to them, they will then agree to rent the sports facility via licence or other mechanism short of a lease to our Club. The offer continues to state that, no lease, which includes security under the Landlord and Tennant Act, is available to the Club because of the Clubs poor financial position and because the Council believe there is a risk to public expenditure.

As supporters are aware the Club has invested its shareholders funds over the last three years to deliver the Clubs new stadium. Architects fees, Legal fees, Planning fees, Specialist reports from Engineers, and Traffic Surveys have resulted in two hundred thousand pounds being spent to deliver our Stadium and now the Council inform us in a formal offer that once the Stadium is completed we are required to hand it over to them as the new owners.

The offer of a rolling licence does not meet the criteria set in stone by the Football Conference neither does it allow the Club to apply for any Stadia Improvement grants.

It is with great sadness therefore, that the Directors must report to its supporters that the conditions as set out in the Councils offer are unacceptable to the Club. The Directors also confirm that their Development Partners have formally put the Council on notice that if for any reason Margate Football Club are not offered a long lease to secure the Clubs ambition of Football League status, they will withdraw from all negotiations.

The Directors are seeking an urgent meeting today with the Council, in a final attempt to negotiate a suitable lease for its Stadium.

The letter of offer received makes clear that the Council does not intend to enter any protracted dialogue over its proposals, a take it or leave it offer.

Your Directors have reported the situation fully to the Football Association via John Moules the Chief Executive of the Football Conference and we are aware that Mr Moules has been in contact with Thanet District Council.

If the Club is unable to change the terms of offer from the Council today and put in place a secured tenure for the Club and its future a full Press Conference will be called later today to advise the Country that we have no option but to withdraw from the league and place the Club into administration.

If the Club is forced into administration a full enquiry will be launched and we shall seek judicial review of the Councils actions.
