Planning Permission

Guest

Recommended Posts

I have just sent a letter to Mr Eziekiel asking him to explain why he still claims he never knew that the stadium was going to be demolished despite planning application number R/TH/03/0122 being approved on 14/4/03.

If you go to www.thanet.gov.uk and go to the planning application site you will clearly see the application has been granted.

As soon as i get a response i will let you all know what was said.

Until then if anyone has a spare £2.5m the builders can start work tommorow

[color:"blue"]This is the pivotal part of option D for next season. We have permission to build the football stadium, and because we have demolished the original facilities, we have an obligation to restore the site under the terms of the Lease.

Of course the money for the project comes from the Commercial Build which is still at the planning stage. However KP is confident that Hartsdown can be ready to host Conf.2 by 1st August. [color:"red"]Perhaps he's got a pile of tenners under his mattress !

As to the claim by Mr E. that we didn't have the OK to do the demolision - is that Mr E.of TDC as Planning Authority or Mr E.of TDC as Landlord ? [color:"red"]It does make a difference !

Thanx DJH. You are correct in your investigation and it is clear to me that they did give permission and therefore they are lying when they said they hadn't given permission as its all there in black and white. When one makes one lie it is often followed by others.

Peters post is very valid.

Irrelevant whether TDC as planning auth. gave permission to demolish(unless a listed building do not think you need planning permission to demolish anyway-just building control authority)

However you would need the landlords consent to demolish and this was persumably never forthcoming(or requested)

Yes ,but the landlords position is all powerful.

You can get all the planning permissions in the world, but if landlord refuses permission. then you are stumped.

There at last seems a bit of recognition from MFC that in fact TDC are being relatively helpful.

If it was an institutional landlord such as an insurance co. MFC would have been out on their ear ages ago.

Have'nt Telford run into a spot of bother with their landlords over this very issue

Wait for the fun and games to start when TDC grant planning permission for the commercial development, and then put on their landlords hat and say'oh by the way we want an upfront £500K premium to vary the user clause in the lease'

Yes, that's what it's there for, it also helps emphasise my point.
