Of course they were discussed and, you may recall, there was virulent opposition to the club moving on to the site by local residents. However, the local authority overruled that opposition and, unless there are restrictions on the amount of noise that can be generated in the lease or in the planning decision, then a nuisance has to be proved in order to secure attenuation of the noise.

 

It is my professional view that a nuisance cannot be proved from the amount of noise generated at a football match on a Saturday afternoon. An evening kick off may be a different matter but with the noise from traffic on the A10 and Carterhatch Lane I feel that the onus of proof of a statutory nuisance, beyond reasonable doubt, would be very difficult. A civil action under common law would depend on the evidence presented by both parties. The aggrieved party would have to demonstrate that the noise could be heard inside their home and it materially interfered with their quiet enjoyment of the property.

 

The fact that the noise can be heard does not demonstrate a nuisance. While sitting here typing in a quiet suburban road I can hear cars in the street, with the windows open, I can hear the M25 around 6 miles away. At all times of the day and night most of us are subjected to the wail of sirens from emergency vehicles. In actual fact urban streets are now quieter than they were 120 years ago with the development of pneumatic tyres, the elimination of street vendors and fewer people living on the streets. However people are less tolerant of noise. When we played at Brimsdown I was surprised at the amount of noise residents had to put up with from low flying police helicopters around sunset. In the summer I can be woken up by airplanes landing at Luton at around 2:00am. Luton is around 15 miles from my house.

 

It is my view that more noise is generated by fans at the game than any music played on the public address system and then one has to look at "best practical means" to abate the nuisance. Perhaps best practical means is a poor display by the team but that would have to be by both sides.

So why push it by turning up the pa level?

Who is there to listen to 15 minutes of music at half time? 

Have you heard the music played at times when someone else selects it?

Wouldn't club info be of more use?

Mbruno - it is a fact that the music is not played loud enough or indeed early enough - thus creating a full atmosphere in the lead up to kick off. Equally as the teams come out, the music is turned on too late and is an appalling and boring choice.

 

I urge the club to address this issue. As a supporter, I love to hear the music in the lead upto games and as the teams come out.

This matter has been discussed for ages and no change made.

However, as all jobs being carried out at the ground our PA Man Andy does it as a favour.

Let's not knock it because finding a replacement "dj" will not be easy, as known from weeks when Andy is not available.

The choice of music is subjective, but why not talk to Andy in person.

 

As for the music for the teams entering the pitch, my view is this could be improved but no one has come up with a good selection agreed by the majority.

 

Perhaps we can run a selection vote.

The club do so much unseen work behind the scenes as a voluntarily run organisation that not everything is going to be to our perfected liking.

 

However, Music is important, when we hear the pro clubs playing music throughout pre match and half time only being interupted for club info, then their must be a commercial benefit for it and i'd imagine it is to appease supporters entertainment. It will also attract the attention of passers by, although the ETFC Ultras are doing a decent job of that as well.

 

I'd say that if anyone has some pro/amateur expertise in this field they should volunteer accordingly proving their abilities and commitments to every home game.

It was the same music as usual and started about the usual time and was around the same level as usual.

 

Just because YOU didn't like the music dosen't mean it's boring or wrong.

 

And as I said before why turn it up to a level that would upset the locals? We will have many bigger problems to overcome over the years to come without adding to them.
