How can you be sued for breaking someones leg in a tackle?

So if i break someones leg there is a possibilty i will have to pay 100k ..thats ridiculous!

 

Football is a contact sport and every player goes into a game knowing that there is a chance they will get injured.....

 

A friend of mine years ago was sued for 10k for breaking someones leg playing for cobham. He is quite a big guy but a gentle giant and wouldnt go out to hurt someone just one of those things. He had to pay up...10k is a hell of alot of money but when ur talking 100k thats your house.familyetc.....

 

Thankfully i have BUPA with work so im covered for injuries.

 

Not sure how i would stand if i was to break someones leg tho...

 

I played in that game for Cobham v Merstham (reserve fixture) and it was a purely 50/50 that resulted in a broken leg (happened right in front of me). Straight after the game it was being talked about how the guy was self employed with a young family etc.....in that case get yourself insurance. If he had had an accident (which it was) when no once else was involved then he would have been proper f*****!

Agree 100% Jurgs I played in the same game that Buck has been sued for and both players went in for a committed tackle and being 2 yards away it was the kind of tackle you see week in week out not a malicous bone in Bucks body sad thing is that the law fees were half of the claim even more than the person that had the accident.

 

And have to agree with NG about claim for anything!

I feel sorry for both Bucks and the guy who broke his leg, that is the one injury a PLAYER never wishes upon their opponent !

The guy who got hurt in that report in the NLP is Gavin Mernagh, who had two stints at Egham Town and will be remembered by us (OK, me) as scoring an extra time hat trick in the Vase against Eastleigh Town before they started being quite good. The guy who did the tackle was apparently covered under his parents' household insurance, which strikes me as odd.

as I said before, football is a contact sport and by playing the game you should accept the risks that you may get injured. If any injury would affect your work whether employed or self employed, you should be covered.

 

In this case, Bucky got a red card so all the evidence in the end came from the referee's report. No video evidence to back up that it was an accident so clubs if you want to protect your players from being sued, it appears you need to video tape every game you play.

So i have my own insurance incase i get injured but am i insured if i break someones leg? ie through the clubs insurance etc.... or can i expect to be sued if i do?

Odd Tempest why ? Rather synical, ever thought that one insurance premium ''maybe'' cheaper than taking two out ? To me that sounds very intelligent that Bucks parents have done their homework to obtain a premium which covers their son for accident whatever it may well be. Perhaps, other footballers should check their family policy as they may have the same cover ! If the insurance company wants to cover all aspects on one premium that's their prerogative......think again !

The problem lies with the Solicitors/Lawyers Fees, as an individual you cannot compete against them,unless you are loaded.These injury lawyers have no morals.as for Mr Mernagh I presume his career was ended.My solution after the case would of been to declare myself Bankrupt,you cant get blood out of a stone.As many A.F.C. Clubs have proved.

I wonder what tempted Mr. Mernagh to sue in the first place, if indeed Bucks never meant to harm and was an accident ?

 

These 'No win, No fee' solicitors may have alot to answer for..........but if they win, who gets most of the money........greedy....lol !!!

That's a name from the past. Remember playing youth football against him (as well as school and district etc).

I was talking to a mate about this on Monday night.

 

He is heavily involved in the legal issues with a large Insurance company, AND he is a footy-freak, so he has a vested interest. His company are looking into the ramifications of this case at the moment.

 

His view is......

 

1. Personal Injury: Down to the Club, AND the player to ensure he has sufficient insurance to cover his needs in the event of injury, (especially self-employed persons.)

 

2. Litigation: In the event of a player receiving a serious injury and taking legal action against the person who caused it, it is unlikely that any insurance company would cover the perpertrator in the event that a court ruled that the injury was caused maliciously.

 

My mates view is that the result of the case in question in NLP, will probably mean a flood of claims in times to come, with a high success rate !!

 

Makes yer fink, dunnit ??

JR - your contact is correct. As I posted previously, Personal Accident (PA) cover is a requirement of CCFL, but the league does not lay down minimum cover. So what you tend to find is that clubs may pay the premiums for a very basic cover. Certainly not enough to cover you if you are self employed or not receiving pay whilst injured.

 

Injuries to opponents (so called 'player on player' cases) are NOT covered by PA and in reality are uninsurable at present.

 

When I researched this issue last year I did make contact with the County & FA but I suspect nothing has been done to progress the possiblity of arranging some form of overall cover.

 

Afraid this is a minefield!
