A Premier League footballer has won a gagging order stopping the public learning about his affair with a team-mate’s girlfriend.

The so-called ‘super-injunction’ was granted by a High Court judge under human rights laws.

The married England international successfully claimed that exposing his infidelity would be a breach of his right to a ‘private and family life’.

So draconian is Mr Justice Tugendhat’s order that even its existence is supposed to be a secret.

This latest example of media censorship provoked fresh controversy yesterday.

A sweeping privacy law – now regularly used by sports stars to shield their lifestyles from scrutiny – has been put in place by judges without the endorsement of Parliament.

Last month, a married Premier League manager succeeded in keeping his identity out of the papers despite being spotted visiting a brothel.

well this has come out today and it looks like some more is coming out, from what i hear, our england captain and father of the year has been a very naughty boy

http://www.guardian....r-gagging-order

England captain John Terry emerged as the footballer who had obtained a gagging order preventing the publication of claims about his private life, after the high court overturned a superinjunction yesterday.

Lawyers for Terry won a high court injunction last Friday, having learned that the News of the World planned to write about his private life. Under the terms of the superinjunction, agreed on privacy grounds, newspapers were unable to reveal who had applied to stop the story.

The judge, Mr Justice Tugendhat, lifted the injunction yesterday. It follows the Trafigura affair in October, when the oil trading company tried to use a pre-existing superinjunction – which prevents even the existence of an injunction from being known – to stop the Guardian reporting a parliamentary question until the outcry forced Trafigura and their lawyers Carter-Ruck to back down.

In the Terry case, Tugendhat said: "I do not consider that an interim injunction is necessary or proportionate having regard to the level of gravity of the interference with the private life of the applicant that would occur in the event that there is a publication of the fact of the relationship, or that [the applicant] can rely in this case on the interference with the private life of anyone else."."

Unfortunately there are some very naughty boys out there and that's why censorship is a very necessary evil

Can't see where Wayne Bridge comes into it.

She wasn't his bird at the time.

Remember Tommy Doc won the F A Cup with Man U.

He got sacked for doing the physio's wife.

He later married her and they are still together.

Can't believe that idiot terry hasn't offered the captaincy up yet.Its the least he should do,then he would be at least seen to be remorseful, capello still doesn't have to accept his resignation but at least it would show remorse

I actually agree with Saint Buzzardboy of Hornchurch on this one.

Its the same as when people go onto family friendly, community clubs forums and use bad language and sexual innuendo's, they should be asked to resign, and if they don't, ban them. I also agree that it shows a certain lack of intelligence when no remorse is shown.

Yeah right, think you will find people don't look up to me as a role model like kids do with terry, and nor do i wish anyone on your forum to idolise me although you are doing a very good job in disproving this.

I'm sure that when Buzzardgirls egg hatches soon, you will be a perfect role model to your little fledgeling who will idolise you, and it wont be long before you bring him or her to family friendly Westlands to enjoy proper football.

next week i think,he will get it overturned being an england international.

Remember shearer getting away with assaulting lenon a few years ago???

We still talk about our heroic goalkeeper being assaulted by some thuggish ruffians in an Essex Senior League Cup Semi Final about 5 years ago, and they got away with it as well. Your absolutely right, there's no justice in football anymore.

think Gerrard or Rooney should have the captains armband

I don't!

Just to clarify my response I think the armband should stay with JT. Personally I think he was the wrong man to get it, however it's been complete genius.

At the time the other contenders were probably:

Rio Ferdinand

Frank Lampard

Steven Gerrard

Given the 18 months that these have had (glassing someone in a boozer, splitting up with the Mrs, Injuries and indiscretions) I think the wise old Italian made the right choice for the team.

I think this is the same going forward. Who are the contenders?

Frank Lampard

David James

Wayne Rooney

I don't think so, do you?

As coup will no doubt have an opinion, the English press have had a generally unhealthy attraction to our England captains since our world cup win in 1066 ( :bigshock: ) and this will not change going forward.

So why change the captain now? So we can have another captain for the press to rape prior to the world cup! Let's face it, there are plenty of skeletons to be dug up about every england footballer young, old, straight or gay.

It's working on the pitch so why change it?

Just imo btw!!!!!!

There's only one sensible candidate and that's Romfords finest, Lord Lampard of Reed Pond Walk.

Tough call this.

Moral high ground United v FC Move On

It's a World Cup year and I am sure if you check your history there has always been a story or two that has broke leading up to previous tournaments.

No Fleet Street sports editor would dream of spiking a story re the England football captain (story too big for back pages now of course).

From a personal point of view, I believe that 10% of Premier footballers earn so much money that they are above the law/criticism...ergo 'Super gagging orders', constant appealing when guilty as charged etc.

Having been involved at the sharp end of Fleet Street in the past, I can say that there are plenty of SGO's which the red top editor's would love to get revoked. Some of them are seriously eye-watering too!

If McClaren had still been England boss, he would have probably received a call from the FA and he would bow and scrape to the powers that be and Terry would be toast.

But with Signor Cappello, things are a tad different. Italians, and most Europeans for that matter, tend to treat alleged sexual misdemeanors with a pinch of salt - when you have a PM such as Silvio Berlusconi it's hard not to.

Personally, I think it is all a storm in a tea cup and we should all move on, but with more so-called sensations ready to break, I have a horrible feeling that now the gloves are off, this whole affair (sic), could have serious implications on our World Cup efforts.

Saying that, it will no doubt all end in tears following a quarter-final penalty shoot-out defeat.

Zut alors....

Terry will still be a captain, with or without the armband.

As has now turned out she had nearly everyone at the club.

Why is John Terry the only one getting stick.

She's as guilty as anyone.
